In this respect, it is worth analyzing the case law of the European Court of Justice which has recently provided the presumption of liability for pollution of the operators which operates installations on land adjacent to a polluted area. As the Romanian case law is concerned, given the novelty of the framework of an objective environmental liability and the low number of cases related to this issue, it is to be developed a constant jurisprudence as the decision rendered by the Romanian Court of Appeal as of March 9, 2009, which forced a polluter to remedy totally and in kind the damage caused to an individual’s house.
<publication_date media_type="online"><month>11</month><day>25</day><year>2021</year></publication_date><publication_date media_type="print"><month>11</month><day>25</day><year>2021</year></publication_date><pages><first_page>66</first_page><last_page>71</last_page></pages><publisher_item><item_number item_number_type="article_number">11</item_number></publisher_item><ai:program xmlns:ai="http://www.crossref.org/AccessIndicators.xsd" name="AccessIndicators"><ai:free_to_read start_date="2021-11-25"/><ai:license_ref applies_to="am" start_date="2021-11-25">https://www.naun.org/main/NAUN/energyenvironment/2021/a222011-011(2021).pdf</ai:license_ref></ai:program><archive_locations><archive name="Portico"/></archive_locations><doi_data><doi>10.46300/91012.2021.15.11</doi><resource>https://www.naun.org/main/NAUN/energyenvironment/2021/a222011-011(2021).pdf</resource></doi_data><citation_list><citation key="ref0"><unstructured_citation>Craiova Ap.
